Terms and Conditions

These terms are the agreement between you and Kudos covering the Kudos mobile apps and this website. They are also the end user licence agreement for the apps: they set out what you may do with the software, and they are the only licence you have to use it. Downloading, installing, or using Kudos means you accept them. If you do not, please do not use the app.

Our Privacy Policy explains what we collect and why, and forms part of this agreement. Apple and Google distribute the apps but are not parties to it - section 12 sets out the terms each of them requires us to include.

1. Who may use Kudos

You must be at least 13 years old to use Kudos. If you are under the age of majority where you live, you may only use it with the involvement of a parent or guardian who accepts these terms on your behalf.

You also confirm that you are not located in a country subject to a United States government embargo, or that the United States government has designated as supporting terrorism, and that you are not named on any United States government list of prohibited or restricted parties. You agree to comply with the export control laws that apply to you when you download and use the app.

2. Your licence to use the app

Kudos is licensed to you, not sold. Subject to these terms, we grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to download and use the app on devices you own or control, for your own personal and non-commercial use. Every right we do not expressly grant you here stays with us.

On Apple devices, that licence runs only to Apple-branded products you own or control, and only as far as the Usage Rules in Apple's Media Services Terms and Conditions permit - except that other accounts associated with you through Family Sharing may also use the app. On Android, the licence is granted alongside, and subject to, the Google Play Terms of Service.

You may not sell, rent, lease, lend, redistribute, or sublicense the app; copy or modify it except as the app itself allows; separate it into component parts; or remove any proprietary notice from it. The app, the Kudos name and logo, and everything in the app other than your own content belong to us or our licensors, and this licence transfers none of that to you.

We may issue updates, and your device may install them automatically. These terms cover any update or replacement version unless that version arrives with a licence of its own, in which case the newer one governs it.

The licence lasts until it is terminated - by you, when you delete the app and your account, or by us under section 9. It ends automatically if you break its terms, and you must stop using the app and delete every copy of it when it does.

3. Your account

You can start using the app as a guest, without giving us anything. A guest account lives on our servers but has no email address attached, which means it cannot be recovered if you lose access to your device. Adding an email address or signing in with Google or Apple turns it into a full account you can get back.

You are responsible for keeping your credentials to yourself and for everything done through your account. Tell us promptly if you think someone else has got into it.

You may delete your account at any time from the Profile tab. Deletion is permanent.

4. Acceptable use and objectionable content

While using Kudos, you agree not to:

  • Harass, threaten, impersonate, or abuse another user - including through usernames, profile photos, applause, or nudges.
  • Upload anything unlawful, hateful, or sexually explicit, or anything you do not have the right to upload.
  • Manipulate XP, streaks, or the rankings by automated or fraudulent means.
  • Attempt to access another user's account or any part of our systems you have not been granted access to.
  • Probe, scrape, overload, or interfere with the service or the infrastructure behind it.
  • Reverse engineer, decompile, or disassemble the app except to the extent the law expressly permits.

Zero tolerance. We do not tolerate objectionable content or abusive users. Anything a reasonable person would find objectionable - harassment, hate speech, threats, sexually explicit material, and above all anything that exploits or endangers a child - is banned everywhere it can appear: task titles, usernames, display names, bios, profile photos, and chat messages alike.

Reporting. You can report content or an account from inside the app, wherever that content appears, or by writing to support@co.dev. We review every report and act on it within 24 hours, which may mean removing the content, suspending the account behind it, or ending that account altogether. You can also block any account yourself at any time, which ends the connection in both directions and stops them contacting you or finding you.

By putting content in the app you accept that we may screen it, review it, and remove it, and that we may remove content or suspend accounts that break these rules. We are not obliged to monitor content, and doing so in one instance does not commit us to doing so in another.

5. Your content

Your tasks, notes, and profile photo remain yours. We claim no ownership of them.

You grant us a limited, worldwide, royalty-free licence to host, store, reproduce, and display that content solely so we can operate the app for you - for example, storing your tasks so they sync across your devices, or showing your profile photo and your completed tasks to the people your privacy settings allow. The licence ends when you delete the content or your account, subject to the retention described in our Privacy Policy.

You are responsible for what you put in the app, and you confirm that you have the rights to it and that it does not break section 4.

6. Following and public rankings

Kudos is a social app, and some of what you write in it is shown to other people. Your activity feed lists the tasks you complete by name, so anyone who can see that feed can read the titles you gave them. By default your profile and your activity are visible to anyone signed in, and anyone can follow you without asking.

You control that from Settings - Privacy: one setting for who can see your profile and progress, another for who can see your activity. Narrowing either takes effect immediately. Appearing on the public ranking makes your username, display name, photo, level, XP, and streak visible to anyone, including people using the app without an account.

You can stop following someone, remove one of your followers, or block an account at any time. Please treat other people's streaks with the same good faith you would want for your own.

7. Kudos is not medical or mental health care

The Grow tools - the focus timer, the breathing exercise, and the meditation - are offered for general well-being. They are not medical devices, not therapy, and not a substitute for professional advice, diagnosis, or treatment.

Do not use the breathing exercise while driving, swimming, or doing anything else where light-headedness would be dangerous, and stop if you feel unwell. If you are struggling, please talk to a qualified professional or your local emergency service.

8. Availability and changes

Kudos is provided free of charge. We may add, change, or withdraw features, and we may suspend the service for maintenance or for reasons outside our control. We will try to give notice of significant changes, but we cannot promise the app will always be available or free of errors.

The app needs an internet connection and a supported version of iOS or Android to work. Keeping the device, the operating system, and the data connection it depends on is your responsibility, as are any charges your carrier makes for that connection. We may stop supporting older operating system versions as Kudos moves on.

9. Termination

You may stop using the app and delete your account whenever you like. We may suspend or terminate your access and your licence if you break these terms, or if we are required to by law. Sections that by their nature should survive termination - ownership, disclaimers, limitation of liability, the app store terms, and governing law - will do so.

10. Disclaimers

To the fullest extent the law allows, the app is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, secure, or error-free, or that any data will never be lost.

We are solely responsible for any warranty we do give, and for maintaining and supporting the app. Neither Apple nor Google has any obligation to furnish maintenance or support for Kudos.

11. Limitation of liability

To the fullest extent the law allows, Kudos will not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of your use of the app.

Nothing in these terms excludes any liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, or for fraud.

12. Terms the app stores require

The apps reach you through Apple's App Store and Google Play, and both stores require this agreement to carry the terms below. They apply to whichever copy of Kudos you installed.

Apple is not a party. This agreement is between you and Kudos alone. Apple is not a party to it, and Apple is not responsible for Kudos or its content.

Apple and warranties. If Kudos fails to conform to any warranty that applies to it, you may notify Apple, and Apple will refund what you paid for the app, if anything. To the maximum extent the law allows, that refund is the whole of Apple's warranty obligation, and Apple has no other warranty liability of any kind in respect of Kudos.

Apple and claims. We, not Apple, are responsible for dealing with any claim you or anyone else makes about Kudos or about your possession or use of it. That covers product liability claims, any claim that Kudos fails to meet a legal or regulatory requirement, claims arising under consumer protection or privacy law, and any claim that Kudos infringes someone's intellectual property rights - in which case we, not Apple, will be responsible for the investigation, defence, settlement, and discharge of it. Section 11 still limits what we owe.

Apple as third party beneficiary. Apple and Apple's subsidiaries are third party beneficiaries of this agreement. On your acceptance of these terms, Apple has the right - and is deemed to have accepted the right - to enforce them against you as a third party beneficiary.

Google Play. Where you installed Kudos from Google Play, your use of it is also subject to the Google Play Terms of Service. Google is not a party to this agreement and is not responsible for Kudos, and the responsibilities Apple disclaims above are ours rather than Google's in the same way.

Other third party terms. You agree to comply with any third party terms that apply to you when you use Kudos, including your wireless carrier's terms and the terms of the store you installed the app from.

13. Governing law

These terms are governed by the laws of the State of California, United States, without regard to its conflict of laws rules. Where you have mandatory rights under the law of the country you live in, those rights are not affected.

14. Changes to these terms

We may revise these terms as the app changes. The date at the top of this page shows when they were last updated, and continuing to use the app after a change means you accept the revised terms.
